My answer has to be no. While the US Constitution grants to the States all rights not given to the Federal Government Article 1 Section 10: Powers prohibited of States. Article IV: The States. Amendment 10 says: Amendment 10 - Powers of the States and People. The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. Because the Federal government can trump the state's rights in certain instances, I don't believe it qualifies as Westphalian Sovereignty if I'm reading the definition of that correctly.

My short answer would be no.

Using the 1861 secession as a reference point, if I am “getting it”, Westphalian Sovereignty implies more sovereignty than even the more avid secessionists had in mind. Even a Confederacy might be too restrictive.

Frankly, my short answer required some quick research since I am as unfamiliar with the terminology as everyone else appears to be.

I am going to read up on it some more and if it jells into anything worthwhile, I’ll get back to you.
