... I was driving towards the fwy on my way to work. There is a light stop that is inclined upwards towards the light. I was waiting for the light to change behind a very shiny pimped-out something or other with its sound system cranked way up. That driver leaned far to the right and out of sight, looking for something in the glove box or passenger side or something. And then the car started to roll back towards me. I honked and honked till the collision. We got out of our cars, and by then the light had changed and all witnesses were gone.

His first words were (in a very sarcastic voice), "well, somebody's in a hurry this morning!" You may or may not have guessed that I have issues controlling my temper sometimes. In this case, I was completely over the top furious. I explained through gritted teeth that he had rolled backwards into me while he was rummaging around. And that I had honked to get his attention. I don't think that my argument persuaded him as much as the axe-murderer vibe I exuded. We parted with a no-harm-done.

He said I had my car in reverse and when the light changed I floorboarded it. Didn't work.

However, back when large trucks had clutches it was different. While I was building my house I worked swing shift driving a mixer and then a Cat 769. The guys in the mixers and town delivery dumps frequently had people pull up right behind them. When the light changed they'd roll back several inches while their foot moved from brake to throttle. People would then claim the truck rolled back onto them, and usually collect.

Standard rule of thumb in insurance issues:

(At least the ones I dealt with) is that the guy who hits the other guy in the back end is the one at fault. Sometimes, if the guy in front stops suddenly for a bad reason, it can go the other way, but I've never run across that personally.
