Its irrelevant.
The Martin-Zimmerman encounter could have gone down in a variety of ways, none of which can be determined now since one of the participants is dead. But there appears to be two possible alternative general scenarios, both of them consistent with Zimmerman screaming.
Z: What the hell are you doing here, nigger? You’ve got no business here. Down on the ground, NOW! (Flashes gun or acts in some otherwise hostile or threatening manner).
M: Screw you, jive-ass honky, I got every right to be here, who the hell are you and what gives you the right to be following me around? (Tackles Z, and starts beating him up in what he feels to be premptive self-defense, “standing his ground” against a hostile and threatening stranger in the dark, as is his right under Florida law).
or…
Z: Excuse me son, but I’m the local Neighborhood Watch and I don’t recognize you. Do you live here? Could you tell me who you are and why you’re here?
M: Screw you, jive-ass honky, I got every right to be here, who the hell are you and what gives you the right to be following me around? (Attacks unexpectedly, catching Z off-guard and knocking him down).
No one knows which one of these two scenarios is closer to the truth. The only surviving witness has every incentive to lie if the first scenario is the more accurate, and we have no reason to believe him if the second is.
Now I suspect the first scenario is the case, because Martin was on a perfectly routine and legitimate stroll, and from what I know about Zimmerman’s police wannabee fantasies and the conversation he had over the phone with officers, telling him to back off and that they would handle it. But I wasn’t there and I don’t know, nobody does except Zimmerman.
If I was on the Zimmerman jury, even though I might be convinced he was guilty of manslaughter (by provoking an incident when he had no need or authority to do so) I have no way of knowing that and the State has no way of proving it beyond a reasonable doubt. I would have no choice but to vote for acquittal.
So maybe it was Zimmerman screaming while he was being pummeled. That still proves nothing.
- The implication may be the screamer was on the defensive.
- The difference is in how it can be made to appear to the jury.
