As much as I hate the orange shitstain with every fiber of my being, he needs to be convicted in court for insurrection before being banned from office on the 14th Ammendment. The only other route, had he been convicted by Congress in his second impeachment, that too would have been sufficient to ban the scumbag criminal traitor pos.

SCOTUS is not allowing a fast trial on Jan 6. The GA trial is about election interference not insurrection. It's very unlikely the CO ruling will stand.

Supporters of the Confederacy never denied their participation in a rebellion. They supported the rebel cause publicly, ran for its public offices, served in its institutions, wore its uniform into battle. They didn't need to be convicted in a court of law, they proudly confessed to their crimes.

Trump, on the other hand, denies his efforts to overthrow a legitimate elected government. He claims the government is illegitimate and elected by fraud. He has never admitted to insurrection, and has cloaked his actions by misdirection, doubletalk and outright lies. Trump has never admitted to the attempted overthrow of the constitution; instead he has attempted to accuse the government of doing so.

He has committed a crime but denied doing so, he must be formally indicted and convicted of that crime and given the opportunity to defend himself in a public trial. I'm not nit-picking legal arguments here, There must be a trial. Judges and jurors must go on the historical record and accept responsibility for their decision.. If not, the 14th Amendment will become a mere tool for the party in power to remove its political opponents forever. That's what Trump would do, we must not succumb to that temptation, no matter how justified we may feel.

That's probably why they had to pass the 14th Amendment.

Even when it was a matter of public record?

That was the origin of the amendment.

It has been determined by the courts that Jan 6th was an insurrection, and it is public record Trump told his followers to march on the capitol.

Its all a moot question, we all know how the supreme court will rule on this... and it has nothing to do with law or the constitution.

Everybody knows Trump is as guilty as hell of trying to stage a coup d'etat against the legal and legitimate government of the United States. But constitutionally, he is innocent until proven guilty in a court of law. If a court can find him guilty, fine, prevent him from running, and THEN, lock him up.

I know its a technicality, but if we can declare him guilty without a trial, then we are just as bad as he is. As far as I know, everyone who went to prison for Jan 6 activities was convicted in a trial. Trump should be no different.

Trump was an officer of the US government and he engaged in an insurrection- end of story, lower level candidates have been kicked off the ballot for participating in the Jan 6th insurrection.

I DO agree, however, it would be preferable to have him lose in the election…

I can't think of anything that would make me happier than removing this grotesque buffoon from the nation's political history once and for all. But this kind of decision, based on a crime which he has not been convicted of in a court of law, is just not fair. Trump must be stopped by a verdict and a jury, or by being soundly trounced in an election, not by the split decision of a panel of judges. Besides, I can't think of anything more likely to provoke, or set the groundwork for, future political violence. His followers are a heavily armed cult that cannot be reasoned with.

I am opposed to this ruling. I believe it to be unconstitutional, and as an old man I am starting to understand just how important fealty to our constitution is. And if Trump becomes President constitutionally, in a fair election, then perhaps this nation will deserve what it gets.

“There is no doubt that Donald Trump is a threat to our liberties and even to our democracy, but in California, we defeat candidates at the polls. Everything else is a political distraction.”
