He has committed a crime but denied doing so, he must be formally indicted and convicted of that crime and given the opportunity to defend himself in a public trial. I'm not nit-picking legal arguments here, There <em>must</em> be a trial. Judges and jurors must go on the historical record and accept responsibility for their decision.. If not, the 14th Amendment will become a mere tool for the party in power to remove its political opponents forever. But constitutionally, he is innocent until proven guilty in a court of law. If a court can find him guilty, fine, prevent him from running, and THEN, lock him up. Trump must be stopped by a verdict and a jury, or by being soundly trounced in an election, not by the split decision of a panel of judges. Besides, I can't think of anything more likely to provoke, or set the groundwork for, future political violence. His followers are a heavily armed cult that cannot be reasoned with.
